3. Eligibility
By using our Services, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract under applicable law.
4. Account Responsibilities
You are solely responsible for maintaining the confidentiality and security of your Amazon Seller Central credentials. SellerWise requires limited access to your account to perform the Services, and you agree to provide accurate, complete, and updated information. SellerWise shall not be liable for any losses arising from your failure to safeguard your credentials.
5. Fees and Payments
SellerWise offers multiple payment models to accommodate different client needs, including a flat subscription-based model, a pay-per-claim model, and customized pricing for high-volume clients. All fees shall be clearly communicated at the time of subscription, and you agree to remit payment in accordance with the terms specified therein. Payment methods accepted include credit/debit cards, ACH transfers, and other electronic payment options as specified by SellerWise. Invoices shall be issued for the applicable fees, and failure to make timely payment may result in suspension or termination of the Services. All fees are non-refundable unless otherwise expressly stated by SellerWise.
6. No Guarantees
SellerWise endeavors to recover all eligible reimbursements; however, we make no guarantees, representations, or warranties, express or implied, regarding the success of any claim, the amount recoverable, or the timeframe for such recoveries. Results are subject to Amazon’s policies, data accuracy, and approval processes, and may vary accordingly.
7. Data Privacy
Your privacy is of utmost importance to us. We adhere to strict data protection protocols to safeguard your account and personal information. 8. Termination
You may terminate your use of the Services at any time by providing written notice to SellerWise. SellerWise reserves the right to terminate the Services for any reason upon providing prior notice. Upon termination, you shall remain liable for any unpaid fees for Services rendered up to the termination date. SellerWise shall not be liable to you or any third party for termination of the Services.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SellerWise shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Services. SellerWise’s liability shall be limited to the amount of fees actually paid by you for the Services rendered. SellerWise shall not be liable for any claims arising from factors beyond its reasonable control, including, but not limited to, changes in Amazon policies, data inaccuracies, or disruptions in Amazon’s systems.
